If you have owned and sold a home in Michigan, you are likely aware that the state collects a tax equal to 0.75% of the sales price at closing. For example, if you sold a home for $600,000, you would have paid $4,500 ($600,000 x 0.75%) in state transfer taxes.
What most people are not awrare of, is that in 1993, the state legislature passed MCL 207.526, which states that properties sold, where the State Equalized Value has declined during the period of ownership, along with meeting additional criteria, are potentially exempt from paying the state transfer tax.
In most cases however, sellers have already paid the transfer tax when they closed on their sale and would need to go through the cumbersome task of determining eligibility and applying for a refund from the State of Michigan.
